Guardianships are necessary when a person cannot make legal and important decisions for themselves. The role of the Guardian would be to make the decisions for that person. The person in need of the decision making is referred to as the "ward".
The prospective guardian or their attorney will need to file a Petition and Application requesting the Guardianship. The individual in need of a Guardian will be examined by three medical professionals to determine the extent of the guardianship necessary.
Once the preliminary documents are filed and the examinations completed, there will be a Court hearing to determine the powers of and appointment of a guardian. In most circumstances it will require approximately forty-five (45) days to have a guardian appointed.
